Day 2 of the training program focuses on the fundamentals of mediation and dispute resolution
Work continued on the intensive training program under the project "Inclusive Justice Pathways: Promoting Inclusive Dispute Resolution for Persons with Disabilities."
Day 2 was dedicated to exploring the core foundations of mediation and dispute resolution. Through interactive sessions, participants focused on understanding and analyzing conflicts, learning about alternative dispute resolution (ADR) mechanisms, mapping out the stages of the mediation process, and developing essential skills for mediators.
Conflict Understanding and Analysis
The day began with a session exploring the concept, types, and root causes of conflict. The training emphasized understanding the nature of disputes, their progression and escalation, and the critical importance of identifying the involved parties alongside their positions, interests, and underlying needs.
The session also introduced various conflict analysis tools, enhancing participants’ capacity to dissect conflicts, read their core elements, and understand context—a vital first step toward selecting the most appropriate intervention and resolution strategies.
Alternative Dispute Resolution (ADR)
The second session examined the concept and significance of Alternative Dispute Resolution, reviewing key mechanisms such as mediation, negotiation, arbitration, and facilitated dialogue.
Discussions highlighted the fundamental differences between these methods, focusing on identifying specific scenarios where mediation serves as the most effective path for dispute resolution.
Mediation and Its Stages
In the third session, participants were introduced to the definition and principles of mediation, the mediator's role and scope of intervention, and the structured stages of a mediation session.
The module covered joint and separate sessions (caucuses), as well as the foundational principles governing the process—chiefly neutrality, independence, and voluntariness—helping participants grasp the essence of mediation and how mediators effectively facilitate dialogue.
Developing Mediator and Negotiation Skills
The final session focused on building essential mediator competencies, including active listening, strategic questioning, reframing, and summarizing, alongside techniques for shifting parties from fixed positions to underlying interests.
Additionally, the session covered negotiation skills and option generation—vital tools that enable mediators to manage dialogue efficiently and support disputing parties in exploring viable solutions.
Toward More Inclusive Mediation
Day 2 marked a fundamental milestone in the training program, bridging general concepts of conflict and mediation with a deeper mastery of resolution mechanisms and mediator skills.
This groundwork sets the stage for Day 3, which will focus specifically on inclusive, disability-sensitive mediation—covering inclusive justice, accessible dispute resolution mechanisms, and reasonable accommodations to guarantee the direct and effective participation of persons with disabilities.
