Engineering Arbitration as a Tool to Support Reconstruction Efforts and Resolve Disputes in the Gaza Strip

As part of ongoing efforts to strengthen alternative dispute resolution mechanisms and support reconstruction initiatives in the Gaza Strip, ACT Conflict Resolution held a consultative meeting on 18 May 2026, bringing together a distinguished group of legal experts, engineers, academics, and specialists in arbitration and dispute resolution. The meeting aimed to explore ways to advance the engineering arbitration framework and enhance its role in addressing disputes arising from reconstruction projects.

The meeting was convened in response to the growing need for specialized professional mechanisms capable of effectively addressing disputes related to construction, infrastructure, and reconstruction projects. Discussions also focused on strengthening the capacities of engineers and legal professionals to help create a supportive legal and technical environment that enables disputes to be resolved efficiently and in accordance with best professional practices.

Participants highlighted the importance of engineering arbitration as an effective mechanism for resolving disputes related to engineering contracts, infrastructure projects, and reconstruction efforts. They emphasized its vital role in supporting recovery and rebuilding processes, reducing disputes that may hinder project implementation, and fostering trust among stakeholders.

The discussions further addressed the legal and technical challenges expected during the reconstruction phase and underscored the importance of developing professional and regulatory frameworks for engineering arbitration. Participants also stressed the need to prepare specialized guidelines and reference materials that can contribute to establishing an integrated and effective system for responding to anticipated engineering disputes in the years ahead.

Participants reaffirmed the importance of bringing together legal, engineering, and academic expertise to support the reconstruction of the Gaza Strip and promote the use of alternative dispute resolution mechanisms that ensure timely resolution of conflicts while reducing pressure on the judicial system.

At the conclusion of the meeting, participants agreed to establish an Advisory Committee for Engineering Arbitration in Reconstruction-Related Disputes. The committee will work collaboratively to develop initiatives and practical tools that strengthen engineering arbitration in Palestine, design capacity-building and public awareness programs, and prepare an action plan for the coming phase to support reconstruction efforts and promote a culture of professional and effective dispute resolution.

ACT Conflict Resolution reaffirms its commitment to working with partners, experts, and relevant institutions to further develop a comprehensive alternative dispute resolution system that contributes to reconstruction efforts, strengthens the rule of law, and supports sustainable development.
