ACT for Conflict Resolution holds a dialogue session on the topic of fraud in arbitration.
ACT held the eighteenth session of the Arbitration Forum, titled "Fraud in Arbitration", on Saturday, 10/12/2024, via Zoom, for an hour and a half.
Dr. Mohammed Al-Mashara, from the Arab Republic of Egypt, residing in Bahrain, who is a practicing legal arbitrator, researcher, lecturer and trainer specialized in the field of arbitration and registered on the lists of the Commercial Arbitration Center for the Gulf Cooperation Countries and the legal advisor to the Al-Aradi Group in the Kingdom of Bahrain, was hosted in a dialogue session prepared by Professor Heba Thouqan from Palestine who is a lawyer and an arbitrator in the field of civil and commercial contract disputes, with the attendance of 100 participants from various Arab countries.
Several topics were discussed in this dialogue session, where the concept of fraud was identified and distinguished from the suspected terms and forms of fraud in arbitration. Practical cases in which arbitration is used to circumvent the law were also addressed, in addition to the role of the annulment judge in confronting and confronting defective rulings. In fraud, the famous doctor presented practical and judicial applications on the subject, including the use of fraud in real estate ownership matters.
Many participants asked their questions about the topic, which enriched the dialogue session with information and rich knowledge of legal arguments.
We note that ACT, through the Arbitration Forum, organizes periodic dialogue sessions through which it sheds light on all topics and problems related to arbitration as an alternative means of resolving disputes, through which it aims to spread the culture of arbitration in Arab societies.
