ACT Conflict Resolution Foundation holds the second Ramadan evening of the Mediation Forum
The ACT Foundation for Conflict Resolution, in cooperation with the office of the lawyer Fat Ben El-Amin-Tunisia, held yesterday evening Wednesday 20-4-2022 the second Ramadan evening entitled "Mediation and other mechanisms (comparisons and approaches), which was co-presented by Ms. Faten Ben El-Amin from sister Tunisia and Mr. Mohamed Hadia with the attendance of 80 participants from Palestine, Tunisia and various Arab countries.
The evening was divided into two main axes, started by Ms. Faten by defining the concept of alternative means or methods for resolving disputes and the importance of relying on them in resolving disputes of all kinds due to their speed and efficacy. The disputes I presented are arbitration, negotiation, conciliation, mediation and cooperative law, where I defined each of these means and compared the similarities and differences between them, focusing in particular on the differences between mediation and arbitration in practice.
Mr. Muhammad Hadia completed the second axis, explaining how mediation and arbitration can be combined in one process with a hybrid system, by following the Med-Arb and Arb-Med models, where he defined each of these models and explained how they work, and reviewed the benefits of these two models and their advantages over following both mediation and arbitration Separately, he also showed a number of restrictions imposed on the parties to the conflict and the expected caveats if these two models were followed. The evening ended by opening the floor to the participants for questions and discussion.
It is worth noting that the Ramadan evenings on mediation are considered a prelude to the continuation of the mediation forum launched by the ACT Foundation for Conflict Resolution in partnership with the office of Ms. Faten Bin Al-Amin, where the third symposium on mediation will be held after Eid Al-Fitr
